Issue Alert 14-02-02 - FAP Divestment
Individuals who transfer countable assets for less than fair market value while applying for or receiving FAP, or within 90 days prior to application, will be ineligible for FAP for 1 to 12 months, depending on the amount of the “divestment."

Issue Alert 14-02-01 - 1171 Application.
Individuals and families must now apply for Medicaid and MIChild on a separate application from other programs, which will also serve as an application for health insurance subsidies for people who are over the income limits for Medicaid and MIChild.

Issue Alert 14-01-07 - Medicaid Residency
Michigan Department of Human Services (DHS) has issued new policy on determining whether a person is a Michigan resident for purposes of Medicaid eligibility, which satisfies some -- but not all -- requirements of federal law.

Issue Alert 14-01-06 - Delayed ACA Changes
The Michigan Department of Human Services (DHS) has delayed the transition to a simplified application for Medicaid, MIChild and Marketplace insurance subsidies. DHS also has delayed the transition to use of Modified Adjusted Gross Income (MAGI) in determining Medicaid eligibility -- two changes that were scheduled to go into effect on January 1, 2014 under the Affordable Care Act (ACA).

Issue Alert 14-01-05 - EBT Issuance System

Issue Alert 14-01-04 - Alien Refugee Status
Changes have been made to the verification policy concerning the alien status subcategory, “refugee” and/or “victim of trafficking.”

Issue Alert 14-01-03 - Agriculture Employment
The definition of “agriculture/related employment” for “migrant/seasonal farmworkers” has been expanded to assist in classification for special rules for eligibility and benefit levels.

Issue Alert 14-01-02 - S-Corporation and Limited Liability Company
Salaries paid by an S Corporation (S-Corp) or a Limited Liability Company (LLC) are considered earned income to the client, even if the client owns the organization, for all programs above except MA; for MA only, DHS is now treats such income as unearned income, which is contrary to federal law.

Issue Alert 14-01-01 - Limited English Proficiency
Local DHS offices have a responsibility in policy and under state and federal law to inform applicants and recipients of – and ensure they fully understand – their rights and responsibilities concerning all DHS public assistance programs. DHS also has a responsibility to honor applicants’ and recipients’ rights, treat them with dignity and respect, and specifically, assist those who need help completing forms or gathering verifications. In sum, DHS should provide every individual equal access to its benefits and services. This is especially true with applicants and recipients who are not fluent in English, otherwise known as having Limited English Proficiency (LEP).

Issue Alert 13-12-02:  Simplified Reporting (SR) policy is changing. The Department will act on any changes in the households circumstances regardless of whether or not the change(s) results in an increase or decrease in benefits.

Issue Alert 13-12-01:   Eligibility for DFAP benefits has been extended to households who were employed in the disaster area at the time of the disaster. Active FAP clients must file a DHS-601, Food Replacement Affidavit, in order to receive DFAP benefits.

Issue Alert 13-10-02: DHS will now accept past due notices from applicants for SER. Previously, only shut off notices were accepted. DHS will no longer process applications for energy assistance SER during non-crisis months June-October. SER energy assistance will only be available from November-May.

Issue Alert 13-10-01:  Food Assistance Program (FAP).  All food assistance recipients; monthly food assistance benefits MAY increase slightly in October but WILL decrease beginning Nov. 1, 2013.
